ReulingSchutte, competent and with empathy.
Our approach is professional, engaged and effective. We pride ourselves on having an in-depth understanding of the situation and paying attention to the personal aspects involved. We lead discussions and negotiations, maintain a solution-oriented approach, make proposals about the process, and monitor progress.
Our mediators help to break through impasses by creating movement on both sides. They may suspend to speak separately and confidentially with the parties. They may ask the participants to prepare and elaborate proposals, brainstorming necessary. They generally do what is useful and necessary to walk the participants one step further down the road to a solution.
Our approach in a specific mediation situation depends on the nature of the case. For example, if team mediation concerns functional collaboration, it is less likely that advisers will participate than it would if the mediation involved a shareholder conflict in which a buyout was being negotiated. If it concerns group mediation, with many participants and advisers, the set-up of the mediation will be adapted accordingly.
Customization is key. Choices about the approach to mediation are always made in close consultation with all those involved.
The mediators of ReulingSchutte have all completed recognized mediation training, are registered with the Mediators federation Netherlands (MfN), and/or are members of various professional associations such as the Platform Business Mediation (formerly Association of Business Mediation), the Association of Construction Mediators, and the Association of Labor Mediators Netherlands. Some of us also serve as mediators for various judicial authorities, such as the Amsterdam District Court and the Enterprise Chamber of the Amsterdam Court of Appeals.
“As a mediator you strive to get the best solution for the situation as it actually is. If you litigate, a judge will decide who is right. In mediation, the parties come to a solution together. Because the solution is not imposed, it has a better change of sticking.”
Eva Schutte en Saskia Reuling, Advocatie April 2022
ReulingSchutte’s mediators properly structure the various phases of the mediation, are fully transparent about the process and closely involve the participants.
Mediation starts with separate and confidential intake interviews. During these meetings, the parties have the opportunity to discuss the issues and explain their views. The rules of mediation (including confidentiality) and the role of the mediator are also clarified. These are included in a mediation agreement to be signed by the mediator and the participants.
Before the intake meetings, agreements are often made with the mediator about certain point. Who will the participants be in the mediation meetings? What documents will the mediator receive in advance, if any? Will advisers participate in the mediation meetings?
In the plenary session with all the parties, the mediator and the participants talk about the issue, about everyone’s point of view and about their underlying concerns, interests and themes. On this basis, possible solution-oriented approaches and scenarios are identified. These are then negotiated under our supervision until concrete agreements are made. We also monitor the written confirmation of these agreements.
In principle, the mediation takes place at our offices in Amsterdam, which has spacious mediation rooms and break-out rooms. Mediation at a specific location is possible on request. Mediation sessions are preferably conducted in person, but online meetings are possible in exceptional situations.
