Employment mediation is a form of dispute resolution in which parties, under the guidance of a mediator, engage a conversation about their working relationship. It can involve various scenarios, such as an employment conflict between an employee and his/her supervisor, disputes among co-workers, between management/executives and employee representation (Works Council), or between management and supervisory bodies (Supervisory Board or Advisory Board). Mediation can also address situations involving misconduct or the outcome of a confidential investigation. Essentially, any employment-related dispute can be resolved through mediation. Employment mediations can also be preventive in nature, aiming to avoid the escalation of a conflict. For example, mediation can focus on guiding a decision-making process, especially within employee representation or management.

The mediator leads the mediation process with the goal of facilitating parties in reaching a mutually acceptable and sustainable solution.

They understand the parties’ interests, are knowledgeable about legal implications, and possess negotiation skills.
